A former official of the Union Carbide India Limited, who was convicted in the 1984 Bhopal gas tragedy case, has failed to get the case diary from the CBI as the judge of a local court hearing the case, has been promoted.
Justice Rajeev Dubey–in whose court the former UCIL official’s appeal was being heard– has been promoted as a judge in the Madhya Pradesh high court, following which the post of the district and sessions judge will fall vacant, said Anirban Roy, counsel of SP Choudhary, the former UCIL (Union Carbide India Limited) official.
“ Due to the promotion, the next hearing will be held on November 8 before a new judge,” he said.
“We’re contemplating of approaching the appropriate authority to create a special jurisdiction for the outgoing district and session judge to hear our appeal in a time bound manner, as he is well versed with details of entire case.”
In 2010, Choudhary along with seven other accused in the case, were sentenced to two years rigorous imprisonment by the chief judicial magistrate’s court.
The convicted persons challenged the order in the court of the district and sessions judge against their imprisonment, the CBI too filed a cross appeal demanding highest possible punishment for the accused by treating each of the 3,800 deaths separately and seeking conviction for every death.
