PEB scam: MP governor's petition to come up for hearing on March 9

The MP High Court will on Monday hear the petition filed on behalf of MP governor Ramnaresh Yadav urging the court to quash an FIR lodged against him in Professional Examination Board (PEB) scam regarding recruitment of forest guards in 2013.

The MP High Court will on Monday hear the petition filed on behalf of MP governor Ramnaresh Yadav urging the court to quash an FIR lodged against him in Professional Examination Board (PEB) scam regarding recruitment of forest guards in 2013. The petition will be heard by the division bench of chief justice AM Khanwilkar and Justice Alok Aradhe.

Senior Supreme Court counsel Ram Jethmalani had filed the petition under article 226 of the Indian Constitution on behalf of the governor seeking quashing of the FIR on several grounds including constitutional immunity enjoyed by the governor which according to him extended not only to immunity from arrest and prosecution but lodging of an FIR against him too.

He had also questioned the veracity of excel sheet on the basis of which governor was implicated in the case citing Congress leader Digvijaya Singh's affidavit before the Special Investigation Team (SIT) claiming that name of chief minister was replaced with Uma Bharti and Raj Bhavan. The veracity of Nitin Mahindra's statement in which he named governor as one of the beneficiaries of the scam was quetioned too on the ground that why should an accused who has been in STF custody since one-and-a-half years name the governor now.
