Rajat Gupta faces tough call from judge

A New York federal judge on Thursday dampened hopes that he would throw out government wire tap evidence in the insider trading trial of Rajat Gupta, a former board member of Goldman Sachs and Procter & Gamble .

A New York federal judge on Thursday dampened hopes that he would throw out government wire tap evidence in the insider trading trial of Rajat Gupta, a former board member of Goldman Sachs and Procter & Gamble .

During a pretrial hearing in Federal district court in Manhattan on Thursday, the government said it is likely to bring slightly revised and expanded charges in a superseding indictment against Gupta by the end of January.

"A final decision has not been made, but more likely than not there will be a superseding indictment," Richard Tarlowe, assistant US attorney told the judge.

"This is a different defendant and he may be entitled to be heard on this issue but looking at it realistically, if I were the defence I would not be too optimistic about this particular motion," Rakoff said.
