Developer to pay Rs 50,000 as compensation for delay in handing over possession

Pulling up an SAS Nagar-based developer for delaying handing over the possession of a plot, the district consumer disputes redressal forum here on Wednesday directed the firm to pay Rs 50,000 as compensation to a Phase-3B1 resident.

Pulling up an SAS Nagar-based developer for delaying handing over the possession of a plot, the district consumer disputes redressal forum here on Wednesday directed the firm to pay Rs 50,000 as compensation to a Phase-3B1 resident.

Disposing of a complaint filed by Suresh Kumar, a resident of Phase-3B1, SAS Nagar, the consumer forum also directed real estate developer K Soni Builders and Promoters (P) Ltd to pay Rs 11,000 for litigation expenses.

The argument of the developer, who blamed shortage of sand for the delay in construction failed to impress the consumer forum.

In June 2011, Kumar had booked a flat in KSB Royal Heights, SAS Nagar, promoted by K Soni Builders and Promoters (P) Ltd with an assurance that its possession would be handed over by December 2012.

Kumar alleged that the developer failed to hand over the flat's possession as its construction is still incomplete.

Denying any deficiency in services, K Soni Builders and Promoters (P) Limited said Kumar had approached them to swap his flat from two bedrooms to three bedrooms without paying any extra cost.
