A day after the appeal in the Ashutosh last rites case came up for hearing, the Divya Jyoti Jagrati Sansthan (DJJS) withdrew its petition from the Punjab and Haryana high court on Friday wherein it had asked the court to put its own order in abeyance for 30 days.
Appearing for DJJS, Mohinder Singh Nain, the petitioners' lawyer, told the court that the DJJS wanted to withdraw the petition as it had filed the appeal before the division bench of the court against the December 1 order.
Following the submissions, the bench of justice MMS Bedi disposed of the petition "as withdrawn".
On December 5, the DJJS had approached the bench of justice Bedi, which had given the December 1 order, saying they wanted to challenge the single-judge order before the division bench, which would require "strenuous efforts' and "some reasonable time", thus the order be put in abeyance for 30 days.
On December 1, the high court had declared Ashutosh dead and asked the government to perform his last rites within 15 days. The high court had also constituted a committee headed by the Jalandhar district magistrate and directed it to carry out the last rites of Ashutosh within 15 days.
Three petitions filed by the Punjab government, DJJS and Dalip Kumar Jha, who claims to be son of Ashutosh, against the December 1 order come up for hearing on Monday, two days ahead of the deadline fixed by the government for the last rites of Ashutosh.
