The Punjab and Haryana high court on Thursday put a stay on the arrest of suspended inspector general of police (IGP) Gautam Cheema in a case registered against him and his accomplices at Mataur police station in SAS Nagar on September 2 on the charges of house trespass and outraging the modesty of a woman.
The court headed by justice Jitendra Chauhan also directed him to join the investigation on October 17 at the police station concerned.
It was on September 2 that the SAS Nagar police had registered a case against Cheema; Ajay Chaudhary, suspended CEO (chief executive officer) of the Ambala Cantonment Board, and Rashmi Negi on the complaint of alleged conman Davinder Singh Gill’s wife Kricpy Khaira. Khaira alleged that Cheema, purportedly under the influence of liquor, molested her on March 20.
The case was registered under sections 354 (outraging modesty), 452 (house trespass after preparation for hurt, assault or wrongful restraint), 342 (wrongful confinement), 323 (voluntarily causing hurt), 506 (criminal intimidation) and 120B (criminal conspiracy) of the Indian Penal Code (IPC), along with the Arms Act.
In her complaint, Khaira had alleged that on March 20, around 10.30pm, Cheema, along with his commandos and two associates (Chaudhary and Negi), entered her house at Sector 70, SAS Nagar, after breaking open the door. They locked her husband in a room at gunpoint but he informed the police on the phone. When the police reached the spot, Cheema told them that it was his family matter and he would handle it, after which the police left the house without any action, the complaint reads.
