Insurance firm asked to pay Rs 15,000 for deficient services

The District Consumer Disputes Redressal Forum, Chandigarh, has directed an insurance company to pay Rs 15,000 as compensation to Zirakpur resident for deficient services.

The District Consumer Disputes Redressal Forum, Chandigarh, has directed an insurance company to pay Rs 15,000 as compensation to Zirakpur resident for deficient services.

While disposing of the complaint filed by Rajiv Sharma, a resident of Zirakpur, the consumer forum asked TATA AIG General Insurance Company Limited to pay claim of Rs 47,534 to the complainant.

“The insurance company has wrongly and unjustifiably repudiated the genuine claim of the complainant. Hence, the deficiency in service on the part of the insurance company as well as unfair trade practice is proved,” ruled the consumer forum while directing the insurance company to pay Rs 7,000 as cost of litigation.

Rajiv's car had met with an accident on June 6, 2013, and after getting the car repaired from an authorised dealer he submitted the claim but the same was denied.

TATA AIG General Insurance Company Limited while justifying rejection of the claim said: “The claim was repudiated mainly on the ground that the complainant had taken the claim in previous insurance policy, but he had never disclosed the said fact to them at the time of renewal of the policy and thereby, claimed no claim bonus and as such misrepresented and concealed the material facts while taking the policy.”
