Man gets 1-yr jail for selling downloaded songs without licence

Terming piracy as lethal, judicial magistrate Aman Inder Singh awarded one-year jail to a Raipur Khurd resident, running a music shop in Sector 18 of Chandigarh, for downloading and selling Bollywood songs without having any licence to do so, after nearly four years of being booked. The court also imposed a fined of Rs 2,000 on him.

Terming piracy as lethal, judicial magistrate Aman Inder Singh awarded one-year jail to a Raipur Khurd resident, running a music shop in Sector 18 of Chandigarh, for downloading and selling Bollywood songs without having any licence to do so, after nearly four years of being booked. The court also imposed a fined of Rs 2,000 on him.

The court, while dismissing the accused’s plea for leniency, in its order on December 9, held, “The accused was selling songs by downloading them in mobile chips from his computer. From the point of a layman, the said thing is very nominal and each person in today’s world of technology and internet do the same without any hassle...The person here is indulging in piracy, which is lethal, and is killing the entertainment industry. This cannot be brushed aside.”

Unimpressed by the plea of false implication, the judicial magistrate held, “The plea that no independent witness was examined at the time of alleged recovery is misconceived, because it is not required in the law as the recovery was duly effected on the spot.”

The Case

On August 28, 2010, the UT police had booked Vikar Alam on the complaint of one Sukhram, who accused Alam of downloading songs of his company in electronic chips without any licence or authority. Police raided the shop and arrested Alam under the Copyright Act and recovered his computer and a data-storage drive used for downloading songs.
