Through the same order, the consumer commission on August 8 set aside orders of consumer forum passed last month, awarding three-month jail to Chandigarh Housing Board (CHB) secretary Mandeep Kaur and CEO Rodney L Ralte for non-compliance of order directing to convert the leasehold property of a Sector-45 resident, Raj Kumar, to freehold.

Challenging the order of conviction, CHB’s counsel Gagandeep Singh Wasu submitted before the commission that there was “no mala fide intention or willful defiance” of the order passed in January 2013, adding that three employees responsible for delaying the file resulting in delay in compliance of the directives had been chargesheeted. Submitting that the directives of consumer forum had been duly complied with, Wasu submitted before the commission, “UT administration and CHB have swung into action for dealing with the delinquents, who apparently indulged into red-tapeism, leading to the non-compliance of the order.”

Considering the submissions, the consumer commission, ruled, “Non-bailable warrants issued against Rodney L Ralte and Mandeep Kaur are ordered to be recalled back unexecuted, immediately. The finance secretary, Chandigarh, and the chairman, CHB, will submit the final action taken report, against JP Singh, Rajesh Kumar Sharma and Veena Rani within three months.”
