MACT awards ₹6.62 lakh compensation to man injured in road accident

The Motor Accident Claims Tribunal (MACT) has awarded a compensation of 6.62 lakh to a 25-year-old man injured in a road accident in 2017.

In the report, complainant Lovely claimed that on April 17, 2017, he was travelling from Ambala city to Ambala Cantt in a Maruti Swift car with driver Talwinder Singh of Lakhnour village, Ambala, and three others namely-- Pawan Anand, Nitin Sehgal and Manoj. Around 11:30 pm, they reached near Kali Paltan bridge where the driver tried to overtake a truck at high speed, when suddenly a cow appeared on the road and while applying brakes, Talwinder lost control of the car and collided head-on with a divider.

Alleging that Talwinder was speeding and driving rashly because of which the accident took place, Lovely filed the report. The driver died on the same day while the others had suffered various injuries.

Admitted to Ambala civil hospital and later referred to Government Medical College and Hospital (GMCH), Sector 32, with serious injuries, Lovely was in hospital for 11 days and remains confined to his bed even now.

The legal heirs of the driver and the owner of the vehicle, in their statement, filed a joint reply. They admitted certain averments in the petition including that the incident had happened, Talwinder was the driver and the complainant had suffered injuries due to this. However, they controverted that the incident was caused due to rash driving and said that any liability of compensation should be cleared by the insurance firm.

Meanwhile, the insurance firm, in their separate statement, denied the entire version of the petition and prayed for its dismissal. The counsel for the firm argued that an additional individual named Partaj was also present with them and the car had more passengers than the permissible limit but didn’t provide any evidence.

The court, considering complainant’s income and additional money spent on his treatment, diet and compensation for suffering and loss of enjoyment of life, fixed the amount as compensation.
