Sonali Phogat case: Co-accused Sukhwinder Singh files for bail

Sukhwinder, who is a co-accused along with Sudhir Sangwan, are accused of having murdered the BJP leader and have been charged under Section 302 (murder) of the Indian Penal Code by the Central Bureau of Investigation (CBI) which took over the case from the Goa Police.

The second accused in the alleged murder of Bharatiya Janata Party (BJP) leader and Tik Tok star Sonali Phogat, Sukhwinder Singh, has filed a bail plea, the hearing for which will take place on January 20.

The applicant’s counsel, advocate Surendra Desai said they have sought a copy of the CBI’s reply, which prompted the matter to be adjourned to the following week.

“Accused No 2 has filed for a bail application, praying for his release on bail. That bail application was fixed today for arguments, but the matter could not be argued today because they (the CBI) didn’t give us a copy of the reply, opposing the bail, in advance. So we said we have to read the reply and then argue. The matter is now fixed for arguments on January 20 at 2:30pm,” said Desai.

Sukhwinder, who is a co-accused along with Sudhir Sangwan, are accused of having murdered the BJP leader and have been charged under Section 302 (murder) of the Indian Penal Code by the Central Bureau of Investigation (CBI) which took over the case from the Goa Police.

The CBI has filed a chargesheet in the death of BJP leader and actress Sonali Phogat charging her manager Sudhir Sangwan and his assistant Sukhwinder Singh of her murder with common intention.

According to the CBI chargesheet, Sudhir P Sangvan and Sukhwinder Singh have been charged under section 302 of the Indian Penal Code (murder) read with section 34 (common intention) and 36 [effect (in this case death) caused partly by act and partly by omission].

Meanwhile, the brother of the deceased Sonali Phogat has filed an intervention application, which has been allowed after the applicant said they would have no objection to the intervention application.

“Possibly he wants to object to the grant of bail as is the settled law, we have given no objection for this intervention. So, the court has passed an order allowing him to intervene,” advocate Desai said.

The CBI took over the probe from the Goa Police in early September after the Goa government acceded to demands from her family and wrote to the Union government seeking that the case be transferred over to the CBI.
