Encroachment in Muzaffarnagar village: Madrasa committee begins demolition after court order

The management committee of a madrasa in Muzaffarnagar’s Phulat village began demolishing a portion of its construction on Sunday after authorities found that the institution had encroached upon 1,200 square metres of gram sabha land.

The madrasa committee brought in a bulldozer and started removing the alleged illegal construction around 2 pm. The demolition continued for over two hours, with around 300 square metres of the structure demolished by the afternoon. Another 900 square metres of construction remains to be removed.
The action concerns Madrasa Darul Uloom Rahimia in Phulat village, where an administrative inquiry found construction on 1,200 square metres of land belonging to the Gram Samaj.
Following the findings, tehsildar (judicial) Arvind Kumar Kuthar issued a notice on August 18 to madrasa operator Hifzurrahman Ansari, directing him to remove the permanent construction and boundary enclosure from the disputed land.
The notice warned if the encroachment was not removed voluntarily, administration would take action to demolish the illegal construction. The dispute had earlier been heard in the court of the tehsildar (judicial), Khatauli, in a case titled Gram Sabha versus Madrasa Darul Uloom Rahimia.
In an order dated May 22, 2026, the court held that construction over 1,200 square metres of land in Phulat village amounted to illegal encroachment. The court ordered the eviction of the madrasa operator from the disputed land and also directed him to pay ₹30,000 as compensation and ₹5,000 as execution fees.
The madrasa management subsequently challenged the order before the court of the additional district magistrate (judicial). On August 17, the ADM (judicial) rejected the madrasa’s appeal filed by the operator of Madrasa Darul Uloom Rahimia.
This paved the way for enforcement of the earlier order. Following the dismissal, the tehsil administration instructed the madrasa management to vacate the disputed land and remove the construction. The disputed portion houses a girls’ hostel within the madrasa premises.
