UP-Rera slaps 1.5cr fine on 9 developers for non-compliance

The Uttar Pradesh Real Estate Regulatory Authority (UPRERA) on Tuesday imposed penalties worth 1.5 crore on nine developers for not complying with orders issued to them. The penalties have been imposed according to Section 38/63 of the UPRERA Act, 2016, officials said.

The authority issued notices to the realtors in response to cases filed against them by homebuyers. These entail realtors not refunding investment money to buyers for delay in project delivery, and not addressing maintenance concerns, among other issues.

If there is delay in delivery of flats for about six-seven years, the authority orders realtors to refund the investment money. All the cases pertain to group housing projects in the National Capital Region (NCR), including Noida and Greater Noida.

“We have intensified action against the promoters, who are not complying with our past orders. We have imposed penalties and given them 15 days to comply or face further action,” said Rajive Kumar, chairman, UPRERA.

“Our objective is to safeguard the interests of homebuyers. We will continue to move against promoters, who are not complying with orders,” Kumar further said.

None of the realtors were available for comments. On the other hand, homebuyers said that UPRERA should strictly enforce its orders.

“These realtors are not taking UPRERA orders seriously. The authority should take tougher steps and deliver justice to homebuyers,” said Ashish Mohan Gupta, president, Jaypee Infratech Limited Real Estate Allottees Welfare Society.

Amit Modi, president (western UP), Confederation of Real Estate Developers’ Associations of India, said, “If the realtors are not taking the orders seriously, the authority should move against them and safeguard the interests of homebuyers.”
