Uttarakhand HC stays contempt notice against chief standing counsel

A division bench of Chief Justice KM Joseph and Justice Sharad Sharma stayed the notice and fixed May 21 as the next date for the hearing in the case.

The case pertains to a petition filed by Trilok Singh Kathot, who had alleged that he was working in the education department since 1995 and from 2011 he had not been provided salary by the government.

After hearing the petition, the court had ordered that he be provided 50% salary with arrears. When he was not provided the same, the court in the next hearing summoned the director, intermediate education, and chief education officer, Rudraprayag.

When court examined the documents submitted, it found that the affidavit filed by the chief education officer was false.

Chief standing counsel Paresh Tripathi, however, told the court that the affidavit was not false and no information had been concealed. Tripathi said that there was just a typographical error in the affidavit filed on behalf of the state government, stressing that no information had been concealed.

However, earlier on April 26 this year, the single bench of Justice Lokpal Singh ordered that a contempt notice be issued against the chief standing counsel and fixed May 14 for hearing in the matter.

The order of the single bench had stated that, “Since, Mr Paresh Tripathi, Chief Standing Counsel, is not deliberately appearing in my court and is avoiding my court deliberately and willingly and he has made a false statement to mislead this court, such an act is contemptuous…”

The court further said that despite the assurance given by the chief standing counsel, “he did not appear on 20.04.2018 and 24.04.2018 and had failed to safeguard the interest of the state...” The single bench order emphasized that the chief standing counsel “tried to defend the erring officer…”
