50 years late in moving court, HC imposes cost of Rs 1 lakh

The Delhi High Court today imposed a cost of Rs one lakh on a person seeking an alternative plot 50 years after his father's land was acquired by the government.

The court said the petition filed by Mange Ram is frivolous as the government had acquired his land in 1958 and the authorities at that time had offered alternative plot which was refused by his family.

Pointing out that he and his father did not take any action during the last fifty years, Justice SN Aggarwal said "this cost has been imposed by the court keeping in mind the conduct of the petitioner in filing of a frivolous litigation after about fifty years of acquisition of land."

"Had there been any substance in the case of the petitioner, he either himself or through his father could have taken legal action for allotment of an alternative plot in respect of land of his father acquired by the government way back in 1958," the court said.
