Gang rape accused want day-to-day trials to end

Two of the four accused in the December 16 gang rape on Friday moved the Delhi high court against day-to-day trial in the case, saying they wanted it to be held on alternate days.

Two of the four accused in the December 16 gang rape on Friday moved the Delhi High Court against day-to-day trial in the case, saying they wanted it to be held on alternate days.

In a petition filed through their lawyer ML Sharma, accused Mukesh and Akshay Singh contended that the pace of the trial, being held every day, was causing grave injustice to them as they are unable to properly instruct their lawyers. The petition will be heard on April 8.

The accused moved the HC after the special court in Saket, conducting the trial on March 28, dismissed their plea saying “such pleas are made to delay the proceedings.”

“Even the prayer that the trial be conducted on alternate days or that the matter be adjourned every time for different dates cannot be allowed, as per section 309 (power to postpone or adjourn proceedings) of CrPC,” the court had said.
