The Delhi high court on Wednesday reserved the order on a plea challenging its recommendation to the Centre to appoint RV Easwar, president of the Income Tax Appellate Tribunal (ITAT) in Mumbai, as an additional judge.

A bench of justice Sanjiv Khanna and justice Manmohan posted the case for fixing the judgment after hearing arguments put forward by DK Sharma, secretary of the Delhi High Court Bar Association (DHCBA).
The Delhi high court collegium had recently recommended to the Centre that Easwar be appointed as an additional judge of the same court.
Sharma claimed Easwar was not eligible for the appointment as a HC judge. He sought an order prohibiting the Centre from acting on the recommendation of the HC collegium.
According to Sharma, the trial court judges are part of the judicial system and their appointment and elevation to the high court takes place as per the constitutional provisions.
