The Jamia Nagar police have registered a non-cognizable report (NCR) against the Okhla legislator for allegedly threatening a group of locals, who were protesting in his assembly constituency. They were protesting against water scarcity, power cuts, underdevelopment and other civic issues.

An NCR under section 506 (criminal intimidation) of IPC has been registered against the AAP MLA. The complaint was filed directly to Delhi Police chief, Alok Kumar Verma, by one Syed Taseer Ahmad and two other protesters -- Sultaan Ahmad and Syed Abdul Ali. The copies of the complaint were forwarded to the offices of chief minister Arvind Kejriwal, L-G, Najeeb Jung, Union home minister, ministry of minor affairs, DCP (southeast) and SHO of the Jamia Nagar police station.

The police may not take any action against Khan since the offence is non-cognizable. In case of a non-cognizable report, the police cannot initiate an investigation or make an arrest without a court order.

The complainants said that they along with other protesters had organized a protest between July 15 and 17 against the AAP-led Delhi government for ignoring development and other issues in their residential area.

“We were holding a peaceful protest to raise issues like underdevelopment of Okhla, worst civic condition, deteriorated condition of roads and lanes, improper drainage and garbage disposal system, and lack of basic amenities like electricity, water, health, hygiene and public schools,” the complainants said in the complaint.

On July 16 around 9.30 pm, the Okhla MLA along with 25 people arrived at the protest venue and allegedly got into a scuffle with the demonstrators. The legislator allegedly threatened the organizers with dire consequences if the protest was not called off immediately.

One of the organizers and also a complainant, Syed Taseer Ahmad, is quoted in the complaint saying the MLA allegedly intimidated him using threatening words. “...agar dharna khatam nahi kiya toh tujhe main kaat ke Yamuna mein phenk dunga (if you don’t call off the protests, I will cut you into pieces and throw the body parts into Yamuna),” as mentioned in the written complaint.

According to AAP, the complaint is politically motivated. There have already been FIRs against 12 AAP MLAs and 11 of them have faced arrests. The party is now planning to approach the Delhi High Court to complain against alleged cases of ‘fake’ cases against its MLAs. “The language used in this complaint and the earlier complaint is similar. Both cases are politically motivated. Delhi Police is towing the line drawn by the Centre,” said an AAP leader.
