Rs 21 lakh for faulty caesarian

The Delhi State Consumer Commission has ordered the ESI Hospital to pay Rs 21 lakh compensation to a woman whose legs had to be amputated, reports Harish V Nair.

The Delhi State Consumer Commission on Monday ordered the Employees State Insurance (ESI) Hospital in west Delhi to pay Rs 21 lakh compensation to a woman whose legs had to be amputated due to an infection caused by a messed-up caesarian section at the hospital nine years ago.

Sudha Dhobriyal, 26, had been admitted to the hospital at Basai Darapur on January 20, 1998. “After the delivery, the doctors had not stitched the wounds properly and some operated parts remained open till they were stitched at AIIMS a month later,” said the commission’s order.

Commission president Justice JD Kapoor and member Rumnitta Mittal said: “The burden of living without both the legs for the whole of life can be hardly compensated… but this is a case of grossest kind of medical negligence and we deem only a compensation of Rs 21 lakh would meet the ends of justice.”
