The Supreme Court on Friday refused to grant interim stay on the Calcutta High Court order directing the phasing out of diesel-powered 15-year-old commercial vehicles, the deadline for which was July 31.
The transporters association's plea to stay the order was declined by a Bench of Chief Justice KG Balakrishnan and Justice P Sathasivam which decided to hear its petition on Tuesday.
When the petiton in this regard was mentioned before it, the Bench said the transporters association, Bengal Bus Syndicate and others cannot be given immediate relief as they have approached the court quite late.
The Bench noted that the first order of the High Court was passed in July 2008 and a modification of it was made in March this year, setting the deadline for phasing out such vehicles by July 31.
The High Court had on March 17 directed that 15-year-old diesel buses, taxis and two-stroke autos causing pollution must go off the roads in the metropolis by July 31.
The state government had in July last year sought time from the High Court to allow autorickshaws to go off the roads from January one this year while 15-year-old buses and taxis were to be phased out by March 31. The High Court had converted the timeframe given by the government into an order.

{{/usCountry}}The association, in its appeal, contended that the order of the High Court was passed on a PIL by a citizen forum without giving them the hearing.
