e-way moves HC, seeks Rs2.5 lakh as damages

The Delhi Gurgaon Super Connectivity Limited (DGSCL) has moved the Punjab and Haryana High Court against the city traffic police, seeking Rs2.5 lakh compensation, for forcing it to open toll gates and letting vehicles pass without paying tax due to long jams, on various occasions.

The Delhi Gurgaon Super Connectivity Limited (DGSCL) has moved the Punjab and Haryana high court against the city traffic police, seeking Rs2.5 lakh compensation, for forcing it to open toll gates and letting vehicles pass without paying tax due to long jams, on various occasions. The traffic department has received a legal notice in this matter.

The expressway operator has also sought directions restraining the department from lifting the toll gates as per its wishes.

The DGSCL claimed there was no provision in the concessionaire agreement signed between it and the National Highway Authority of India (NHAI), which allows the traffic police to act on these lines.

On numerous other occasions, the traffic police had opened the toll gates when jams spanned for a kilometre on the expressway.

A DGSCL official said the firm had filed a petition in the high court against the traffic police for compensation of revenue losses incurred by it.

“The traffic police opened the toll gates only when congestion reached the tipping point in the larger interest of the public,” Bharti Arora DCP (traffic) told Hindustan Times on Friday.
