A city court has stayed the arrest of popular music composer Vishal Dadlani till this Friday, and asked him to join investigations.
Dadlani filed an he anticipatory bail last week through advocate Umresh Gandhi, which District and Session judge Deepak Gupta took up on Monday and adjourned to September 23 for consideration.
The defence counsel argued that the case did not fall under the ambit of Section 153-A, and his client had no intention to hurt the religious belief of any section of society. The complainant was not a representative of Jain community, Gandhi said.
Opposing the interim bail, the prosecution had argued that the Jain monk Tarun Sagar was as highly venerated saint, adding that the feelings of the community were “greatly hurt”.
Earlier, Dadlani had moved an application in Punjab and Haryana High Court for quashing of the complaint, which the court declined.
On August 29, the Ambala police booked Dadlani and Congress party national spokesperson Tehseen Poonawala for allegedly posting offensive posts “denigrating” the Digambar saint relating to a speech he gave in Haryana assembly on August 26.
On the complaint of local resident Puneet Arora alleging that his religious feelings were hurt, the FIR was registered against the duo at Cantt police station under sections 153-A (promoting enmity between classes), 295-A (maliciously insulting the religion or religious belief of any class) and 509 (uttering any word or making any gesture intended to insult the modesty of a woman) of the IPC.
