THE ALL India Muslim Personal Law Board (AIMPLB) today demanded abrogation of Article 44 of the Constitution, which envisaged uniform civil code for citizens. The Board said either the Article falling under Directive Principles of State Policy should be deleted from the Constitution or the Muslim community should be exempted from its impact.
Talking to newsmen here on Tuesday, general secretary of the Board Maulana Syed Nizamuddin said without its deletion the threat to Muslim community would continue. The Board said personal law formed an integral part of the community and common civil code was not acceptable in any condition.
Nizamuddin said while there was no possibility of amendment in the ‘Shariat’ (Islamic laws), it would also not accept any outside intervention through constitutional provisions. Asserting that Muslim Personal Laws in no way hampered the development of the country, the Maulana said Article 44 was a permanent threat to the community. The Board has also expressed displeasure with provisions of the Waqf Act, 1995. Laying stress on strengthening the Act, the Maulana said the present Act failed to protect waqf properties in the country. About pending proposal of right to inheritance to wife and daughters in agriculture properties, Nizamuddin said the State Government had so far not amended the UP Zamindari Abolition Act to solve the issue. He said the issue was very much on the agenda of the Board.
The Board today summoned a meeting of convenors of Islahe Mashra (social reforms) programmes to review progress. He said nearly 70 convenors from all over the country attended the one-day conference to present report about the programme. He said the community had been facing lots of social problems and the Board making efforts to resolve them. Ruling out the possibility of banning ‘triple talaq’, which has been haunting majority Hanafi sect in the country, Nizamuddin said there had been considerable control in this matter. He said a recent survey of 500 families indicated that there were only three ‘talaqs’ and two of them were sought by wives. Nizamuddin said that ‘Ulemas’ (clerics) had been asked to promote ‘dowryless’ marriages. Expressing concern over rising cost of marriages, he said the Board had been mobilising the people to control expenses. In this connection the Board today constituted three committees to chalk out priorities and method for implementation for further social reforms.
