Applications to delink MLNMC, SRNH from AU rejected

THE ALLAHABAD High Court on Monday rejected the applications filed by the State Government to de-link Moti Lal Nehru Medical College and Swaroop Rani Nehru Hospital from Allahabad Central University. A Division Bench comprising Justice Sunil Ambwani and Justice Dilip Gupta rejected the State Government applications. Earlier, the Allahabad University was a State university under the provisions of the UP State Universities Act 1973.

THE ALLAHABAD High Court on Monday rejected the applications filed by the State Government to de-link Moti Lal Nehru Medical College and Swaroop Rani Nehru Hospital from Allahabad Central University.

Earlier, the Allahabad University was a State university under the provisions of the UP State Universities Act 1973. Later, it became a Central University under the provisions of the University of Allahabad Act 2005, which came into force from July 14, 2005.

The Act and the Statute of the Allahabad University provides that the Moti Lal Nehru Medical College (MLNC) and Swaroop Rani Nehru Hospital (SRNH) shall be ‘University Colleges’.

The issue raised by the State Government through these two applications was that the Statute 30 (4) of the First Statutes of the University should be amended by the Executive Council of the University to exclude the Moti Lal Nehru Medical College and Swaroop Rani Nehru Hospital as University Colleges.

The State Government wanted that MLNC and SRNH should remain with the State Government.

Rejecting the applications, the court observed: “The Act declares the University of Allahabad as an Institution of national importance.

The university college’ has been defined under section 3 (x) of the Act to mean a college or an institution maintained by the University or admitted to the privileges of the University as a faculty. Under section 7 of the Act, the university has the power to establish and maintain university colleges for imparting instructions and conducting research.”
