A woman’s complaint against her software engineer husband prompted the police to arrest the man and book him under the controversial Section 377 of the Indian Penal Code (IPC) that criminalises gay sex, prescribing a maximum sentence of life imprisonment for indulging in “carnal intercourse against the order of nature”.
In her October 20 complaint, which HT has a copy of, the woman attached a CD containing images and footage of her husband having sex with another man as evidence of the ‘crime’.
The woman’s husband, who works at Infosys, was arrested on October 26. He is in judicial custody at present.
A senior police officer dealing with the case refused to comment but admitted on condition of anonymity that the police have gone purely by the letter of the law. “It is for the courts to decide what kind of sex goes against the laws of nature,” he said.
According to the complaint, the couple married in November 2013 but the marriage was not consummated, leading the woman to believe that her husband was suffering from a performance disorder. She tried to get him to meet a doctor several times but failed.
When the woman found out that men unknown to her visited their home in her absence, she started suspecting that her husband could be gay, the complaint said.

{{/usCountry}}The complainant then installed hidden cameras with a recording facility inside their home and left for her parents’ home for a 10-day break. When she returned, she found footage of her husband sharing intimate moments with another man and turned in a CD with the footage to the local police station along with her complaint.
