The agency has sought a categorical mention in the rules under the Delhi Special Police Establishment (DSPE) act ensuring that the director continues to be a part of the appointment process.

Sinha has raised objections to the recently passed Lokpal act, saying that as per the amended Section 4BA(3) in the DSPE the Centre will appoint the director of the prosecution wing on recommendations of the Central Vigilance Commission (CVC).

According to Sinha, nothing has been mentioned about the CBI director being part of such an appointment process. Sinha wrote the letter on Jan 16, wherein he further pointed out contradictions in the sections related to the appointment of superintendent of police.
