Holding that consensual sex with a woman on a false promise to marry amounted to rape, a Delhi Court on Tuesday awarded seven-year rigorous jail term to a man who made physical relations with his girlfriend on the pretext of marrying her.

"The victim gave her consent for sexual intercourse under the misconception of the fact that the accused would marry her and hence, the consent was no consent in the eyes of law and the offence is proved," said Additional Sessions Judge (ASJ) Rakesh Tewari convicting one Dharmender on the charge of rape.

The court also imposed a fine of Rs 20,000 against Dharmender who was also found guilty of cheating the woman and beating her up when she had gone to his house.

The court, however, released Sumitra and Reema, mother and sister of the convict respectively, on probation.

Earlier, the mother-daughter duo was held guilty for belabouring the victim who had approached them seeking their intervention in getting married with the convict.

She had further alleged that all the three accused had mercilessly beaten her up when she went to their Khichripur residence in east Delhi.

Later, police nabbed all the three after the medical examination of the victim conclusively established that she was sexually assaulted.
