To recall, on October 16, the court had taken a serious view that the police department was not presenting instructions in bail matters and had asked for DGP’s personal appearance. In six cases, the court had no option but to grant bail for want of instructions.

Bua Singh filed his affidavit before the court, citing the steps taken by him to check such incidents in future.

While taking the affidavit on record, Justice Vinod Prasad exempted personal appearance of the DGP for future dates. Advocate-General SMA Kazmi and Government Advocate Vijay Shankar Mishra represented the State government in the court proceedings.

The court had passed this order of personal appearance in the bail application of one Madan of Badaun district.

In his affidavit, DGP said that on September 6 he had issued instructions to the senior superintendent of police/superintendent of police of all districts to comply with the High Court’s order and present the instructions in bail matters in the office of the government advocate, High Court, in time.

Further, on October 17, he issued a circular fixing the responsibility of SSPs and SPs in the matter.

The DGP assured the court that necessary steps would be taken to ensure that instructions in bail matters reached the office of the government advocate within time.
