Following his refusal to call a meeting of all the 38 high court judges to discuss his continuation, at least seven judges are understood to have met on Saturday, HT has learnt.
The judges declined to divulge the details of the meet. “Judges do not talk to the media,” said a judge who attended the meeting.
Justice D.V. Shylendra Kumar (58), the first judge to question the Chief Justice of India (CJI) on declaration of judges’ assets in August, went public with his demand on Saturday that Justice Dinakaran should go on leave.
“This kind of response from the chief justice has only confirmed my worst fears that he (Dinakaran) may even now continue to abuse and misuse his powers … even when he is no more discharging his duties …," Justice Kumar said in his blog.
"I naturally expected that the chief justice will gracefully proceed on leave and ... desist from exercising any functions which are part of the duties ….”
His demand found support from the Advocates Association of Bangalore, which asked the CJI to transfer Dinakaran.
Slamming Dinakaran, he said, “Well grace, propriety and good conduct are definitely not the strong points of our chief justice… No one can, and should, sit as a judge in his own cause … Extraordinary situations call for extraordinary remedies and I am testing one such remedial measure," the judge added.
