Pepsi, a six-year-old performing elephant that killed a man who teased it with a piece of sugarcane has been "acquitted" of any crime and will not be put to death, Malaysian police said.

The sweet-toothed jumbo, part of a five-elephant show troupe from Thailand performing at a Buddhist temple in northern Kedah state, gored and trampled a 50-year-old rubber-tapper after he tormented it during a break in the show on Friday.

Police deputy superintendent Mohd Sukri Awang said police had decided no criminal action was involved, while the wildlife department said no action would be taken against the elephant, The Star reported.
