Ex-DGP alleges tampering of transcripts

Former director general of police, Rahul Gopal, who was arrested in 2004 by the Anti-Corruption Bureau (ACB) for allegedly taking bribe from a builder, has filed a petition in the Bombay High Court.

Former director general of police, Rahul Gopal, who was arrested in 2004 by the Anti-Corruption Bureau (ACB) for allegedly taking bribe from a builder, has filed a petition in the Bombay High Court.

Gopal, along with another accused, Govind Chandak, has in the petition said the transcripts of the intercepted telephone conversations be excluded during the trial.

He alleged that there was a high possibility of them being tampered with since they were neither sealed immediately after the recording was over nor were the seals opened following court order.

The division bench of Justice Ranjana Desai and Justice RG Ketkar has asked the ACB officer concerned to remain present in court on Tuesday.

The ACB had intercepted calls from November 1 to November 4 in 2004 without proper sanction, alleged the petitions.

Besides, the sanction given by the additional chief secretary, home department, under the Indian Telegraph Act was illegal and void.
