Factory MD?s writ dismissed
IN A significant judgement, the Allahabad High Court on Monday dismissed a writ petition filed by managing director of Triveni Glass Factory, Iradatganj, JK Agrawal, seeking stay on his arrest in the murder case of a trade union leader Amrendra Kumar Pandey who was the president of Triveni Sheet Glass Workers? Union.
IN A significant judgement, the Allahabad High Court on Monday dismissed a writ petition filed by managing director of Triveni Glass Factory, Iradatganj, JK Agrawal, seeking stay on his arrest in the murder case of a trade union leader Amrendra Kumar Pandey who was the president of Triveni Sheet Glass Workers’ Union.

Passing this judgement, a Division Bench comprising Justice RC Deepak and Justice RN Mishra observed, “Since the complicity of the actual shooter/shooters has not been disclosed in the FIR and the investigation into the case is going on, therefore, it may be fair and proper to put the investigating agency at liberty to investigate the matter freely and properly without any interference therein’’.
Elaborating its stand, the court further observed, “No interference in this regard is required in such a sensational murder, specially when the arrest of the co-accused CP Yadav, similarly situated under the same facts and circumstances of the case, and that too of KK Gupta has already taken place’’. Co-accused CP Yadav is the deputy general manager of Triveni Glass factory and another co-accused KK Gupta is the chief security officer of the same factory.
Lastly, the court said, “No interference in the FIR is warranted, therefore, the petition deserves to be dismissed in toto at the very initial stage’’.Earlier, during the court proceedings, the petitioner was represented by senior advocates Satish Trivedi, JS Senger and VP Srivastava . Another senior advocate Ravi Kiran Jain, assisted by Nandita Adawal, along with senior advocate UN Sharma and advocates Harbansh Singh and Himanshu Singh had opposed the petition.
Additional Government Advocate Mewa Lal Shukla had opposed the petition on behalf of the State government.
It may be recalled that Amrendra Kumar Pandey, a trade union leader and president of Triveni Glass Factory here was murdered on March 24. An FIR was lodged by uncle of the deceased at the Ghoorpur police station the same day under Section 302 (murder) and 120B (conspiracy) of the Indian Penal Code.
The FIR alleged that petitioner Agrawal had threatened Pandey not to be involved in trade union activities and had ultimately got him eliminated.
Agrawal challenged this FIR in the High Court, requesting the court to stay his arrest and also quash the FIR.

Advocate awarded: Union Ministry of Law and Justice has awarded Devendra Kumar Tiwari, an advocate of Allahabad High Court, for writing two books relating to law in Hindi language.
These books include Dahej Vidhi (dowry laws) and Criminal Trial.
