The direction was given by Justice DG Deshpande and Justice Vijaya Tahilramani on a petition filed by social activist Satish Nadkarni.

Husain's counsel Amit Desai submitted that the painter had already tendered an apology before the Supreme Court in a matter pending in the apex Court.

The petitioner submitted that he had filed several complaints in various police stations in Mumbai but the police had taken no action treating them as non cognizable complaints.

The petitioner submitted that Husain had hurt the religious sentiments of the people with such paintings and that criminal action be taken against him under the provisions of IPC.
