THE ALLAHABAD High Court has ruled that unless a marriage is held void by a competent court of law, the relationship of the husband and wife would continue.

The court further ruled: “Besides, the wife, who does not have sufficient source of income, would normally be entitled to interim maintenance and litigation expenses.”
Passing this judgment, a Division Bench comprising Justice VM Sahai and Justice Sabhajeet Yadav quashed the order of a Family Court judge, Allahabad.
The Family Court had rejected the application of Kavita Gupta (wife), seeking interim maintenance. The Family Court was of the view that as per the proceedings under section 12 of the Hindu Marriage Act, the marriage could be declared null and void. Therefore, during the pendency of application, under section 12, the application for interim maintenance, is not maintainable, the Family Court said. The HC passed the order on a petition filed by Kavita Gupta challenging the order of the Family Court judge.
HC directive to UP Board
THE ALLAHABAD High Court has asked State counsel to inform the court whether the Board of High School and Intermediate Education has taken any decision to introduce moral and physical education (theory paper) in the High School and Intermediate examinations 2007.
This order was passed by Justice SN Srivastava while hearing a writ petition filed by Iqbal Hussain of Moradabad district.

{{/usCountry}}The court has also directed the authorities concerned to furnish certain information regarding position of secretary in the Board, the number of members managing the affairs of the Board, number of members required to compete the quorum of Board’s meeting and present number of members of the Board. The court has ordered to list the case after ten days.
Secretary of the Board of High School and Intermediate Education, Vasudev Yadav was present in during the hearing of the case. Earlier, the court had directed the Board authorities to introduce the moral education and physical education in the examinations conducted by the Board.
Lawyers put up blockade
A group of lawyers put up a road blockade jam in front of the High Court gate on Kanpur Road protesting against the kidnapping and killing of Ved Prakash Shukla, a lawyer of Jaunpur.
Lawyers led by Rajesh Tripathi and Santosh Mishra raised slogans and demanded compensation up to Rs 5 lakh to the family members of the deceased.
They also demanded stern action against those who were involved in killing of the lawyer.
Expressing concern over the deteriorating law and order situation in UP, the lawyers said that killing of a lawyer was a matter of serious concern for all right-minded persons.
