Justice Rakesh Sharma passed the above orders on the petition filed by a general category candidate, Radhey Shyam through advocate Raghvendra Singh.

The selection list was quashed on the ground that the selection process had been vitiated as the reservation quota had exceeded the 50 pc norms as out of 397 posts 219 had been given to the reserved category candidates.

It was argued on behalf of the petitioner that he had been selected in the initial process and was called for interview on July 7,2003. In the final selection list declared on July 19,2003, the petitioner’s name was found missing though he had fared well in the interview.

If 21 candidates of the reserved category had not been taken in excess, the petitioner would have been selected, it was urged. The orders were passed accordingly.

Counsel for the KGMU informed the Bench that the matter of private practice by the government doctors was under active consideration of the KGMU authorities and a decision would be taken up very soon.

The Bench has ordered the petition to be listed for hearing after three weeks.
