The Bombay High Court recently refused to quash the suspension of the trustees of Lilavati Kirtilal Mehta Medical Trust that runs the super-specialty Lilavati Hospital at Bandra, stating that there was no need to interfere with the order of the joint charity commissioner (JCC).
Three suspended trustees — Vijay Mehta, Sushila Mehta and Dr Amritlal Shah — had filed the petition seeking quashing of the suspension orders issued by the JCC on October 10, 2008. The JCC had suspended the exercise of powers of five trustees pending inquiry under the Bombay Public Trust Act, 1950, following allegations by other trustees of misappropriation of funds.
However, the High Court has kept the suspension order in abeyance for a period of two weeks to allow the petitioners to appeal.
