HC to Govt: Enforce PNDT Act

IN AN important step towards checking female foeticide in the State, the Allahabad HC has directed the principal secretary, Medical and Health, to file a reply on progress made in enforcement of the Pre-Natal Diagnostic Techniques Act, 1994. This Act was passed to check female foeticide. Passing this order, Justice Sunil Ambwani observed, ?The enforcement of the PNDT Act has become absolutely necessary, as there are repeated complaints of unauthorised use of modern diagnostic techniques of female infanticide, as well as unauthorised persons operating ultrasound machines.?

IN AN important step towards checking female foeticide in the State, the Allahabad High Court has directed the principal secretary, Medical and Health, to file a reply on progress made in enforcement of the Pre-Natal Diagnostic Techniques (Regulation of Misuse) Act, 1994. This Act was passed to check female foeticide.

Passing this order, Justice Sunil Ambwani observed, “The enforcement of the PNDT Act has become absolutely necessary, as there are repeated complaints of unauthorised use of modern diagnostic techniques of female infanticide, as well as unauthorised persons operating ultrasound machines.”

The court further said, “This must be given top priority, as it is not only an offence under the PNDT Act and the Indian Penal Code provisions, but is also an offence against humanity.”

The court passed this order on a contempt petition filed by Rajesh Kumar Srivastava, seeking enforcement of apex court directives in the State regarding ban on unauthorized medical practitioners (quacks).

In order to check quacks, the court also directed the State counsel to inform the court the progress in the matter of publishing ‘Authorized Medical Care Directory’ for the State, which may provide information about qualified and registered medical practitioners, district wise, specialty wise and facility wise, respectively.
