HC upholds ban on sex selection

The Bombay High Court has upheld a legal provision, which bans technique of sex-selection before conception.

The Bombay High Court on Thursday upheld a legal provision, which bans technique of sex-selection before conception.

Vijay and Kirti Sharma, a couple which already had two girls, had challenged the constitutional validity of the Pre-conception and Pre-natal Diagnostic Techniques Act, 1994.

Their contention was, since they had two daughters, they may be allowed to select the sex of their next child, which is disallowed by the Act.

The division bench of Chief Justice Swatanter Kumar and Justice Ranjana Desai dismissed their contention saying that in view of the imbalanced sex-ratio in the country, the provision was valid.
