HELMET CHECKING drive starting from today is likely to face legal battle again.

Court of the civil Judge (senior division) had stayed helmet-checking drive on the petition of the general secretary of the Central Bar Association Praveen Fighter.

Fighter had filed a case against helmet checking drive and made party the State Government, the district magistrate, the SSP Kanpur City and the SP (Traffic) and case is continuing in the court for disposal. 

Talking to Hindustan Times, Fighter said that he would submit the objection against the proposed drive before the trail court tomorrow.      

However, the court sources said that SP (traffic) had informed the court through a letter dated August 31, 2006 that due to rainy season there was spurt in road accident cases and most of the casualties occurred due to head injuries.

Therefore, in the interest of public safety, it was decided to launch helmet-checking drive from September 2, 2006. The letter further stated that since the court had passed the order that before pre intimation, no helmet checking drive should be initiated, therefore, the information about the same was being sent to court.

However, Fighter expressed concern over the timing and short duration between intimation and start of the helmet checking drive by the police.

He said that the police, before the start of the drive, should give 30 days notice.

He said that norms adopted by the police for intimation about the proposed drive was unconstitutional.
