The High Court’s directive came on a public interest litigation seeking direction to the Government to give its consent for prosecuting under section 19 of Prevention of Corruption Act in all those cases in which the Lokayukta had made recommendations after probe.

A division bench of the Madhya Pradesh High Court comprising Chief Justice A K Patnaik and Justice Ajit Singh directed the Government to file a reply stating either the sanction is given or the authority concerned refused to give sanction
for prosecution of the officials in different cases recommended by the Lokayukta.

The court said the Government should mention in its reply the reasons in case where the authority concerned did not issue the orders for prosecution of the officials.
