ADIDAS FIFA FAIR PLAY FLAG BEARER

' (HEREINAFTER REFERRED TO AS THE “CONTEST”) PROMOTED BY M/S HT MEDIA LTD (HEREINAFTER REFERRED TO AS HTML) AND ORGANISED BY ADIDAS. THE RULES CAN BE AMENDED OR VARIED FROM TIME TO TIME BY THE PROMOTER AND THE ORGANISER.

This contest shall be valid for limited period starting from 6th May 2010 to 12th May 2010.

This contest shall be restrictive for kids in the age group of 12-16 years.

This contest is for Indian nationals only and shall only be open for residents of Delhi, Mumbai, Bangalore, Kolkata & Chandigarh

The participants need to answer few questions pertaining to football; from the correct entries winners shall be short-listed.

The contest has been divided into two parts: 1.those who are willing and have parental/guardian permission to go to South Africa; 2. those who would be playing to win Football gear.

AS THE ADIDAS FIFA FAIR PLAY FLAG BEARER

For those registering and participating to go to South Africa as the adidas FIFA FAIR PLAY FLAG BEARER in the online questionnaire, must have passport and compulsory parental approval. (For non –passport holders: the winners would apply & arrange for a valid passport within 3 weeks of being selected, failing which their entry would be canceled & the next valid passport holder in the waiting list would be selected)

Participants registering online will have to take an adidas speed test, which is a final selection parameter and winners will be selected basis the fastest time clocked in the ground event.

Participants must download the indemnity form and carry the duly filled & signed by their parents/guardian for the ground event at the given locations.

Participants are required to make their own arrangements to reach the venue for the ground event on 16th May 2010 (in delhi, mum, chandigarh) at the specified time. adidas will send information of the time & location via email post the completion of the online registration.

Two lucky winners (with one parent each) from bangalore will be chosen and flown down to delhi ground event by Fever 104 fm

The parent/guardian of the participant understands and agrees any injury/damage to property sustained by the participant during the trip shall not be the responsibility of adidas or HTML in any manner whatsoever.

Subsequent to the announcement of the winner, an itinerary shall be issued by adidas highlighting the structure of the trip. adidas can unilaterally make changes in the said itinerary from time to time, if it is desired, shall hold no responsibility for such changes. adidas shall not be responsible in any manner whatsoever for not complying with the schedule as mentioned in the itinerary, owing to any unforeseen circumstances, natural calamity, or any other reason.

Any claim or dispute of any nature whatsoever shall be solely dealt between adidas and the participant and HTML shall have no role in the same whatsoever.

Trip is likely to be organized b/w June to July, 2010. Winner will be informed about the trip date in advance by adidas.

adidas has a sole authority to change the trip dates, or schedule.

South Africa Trip

” prize Includes:-

1 return air ticket to South Africa (Airfare & Visa fee included). adidas will not entertain any request for additional tickets for a companion or parent/guardian.

Flight boarding destination in India will be at Delhi International Airport only.

Tickets to the specified Football Match & match venue transfer.

Accommodation on twin sharing basis and transfers to and from the Airport.

adidas will not entertain any request for extension of stay by winner in South Africa .

Any other expenses other than those mentioned therein shall be borne by the Winner.

All entrants must hold a valid passport. (For non –passport holders: the winners would apply & arrange for a valid passport within 3 weeks of being selected, failing which their entry would be canceled & the next valid passport holder in the waiting list would be selected)

adidas shall not be liable for any loss or damage whatsoever that may be suffered, or for any personal loss, theft or injury that may be suffered (including loss of life), to a Winner or his accomplice directly or indirectly, as part of the trip in India or outside India.

adidas shall not be held responsible incase of cancellation of the event due to natural or unforeseen circumstances such as rain or any other calamity.

The Winner hereby expressly acknowledges and undertakes that adidas shall not be held responsible for any alterations to the flight supplier, routes, destination or dates.

adidas responsibility ceases once the ticket is issued to the Winner, in the event the Winner does not travel on the ticket or gets it cancelled on his/her own from the airline, adidas shall not be responsible to pay back any charges or ticket amount to the Winner under any circumstances.

If the flight gets cancelled due to any unforeseen circumstances then the Winners will directly deal with the airline for any further flights available. adidas shall not be held responsible for the availability of the same.

THOSE WHO WOULD BE PLAYING TO WIN FOOTBALL GEAR:

This contest is open for the participants between the age group of 12-16 years whether possessing a passport or not.

The participants need to answer few questions pertaining to football, from the correct entries winners shall be short-listed.

Winners shall be awarded adidas football gears (200 entries for internet and 100 for sms winners). Each “adidas football gear” prize includes:

A T shirt from the Official License Products range

A Cap

A Sipper

GENERAL TERMS AND CONDTITIONS FOR THE ABOVE MENTIONED CONTEST:

Only those entries, which are received by HTML, shall be considered for the contest and HTML shall not be responsible for non-receipt, delay of any entry. HTML does not take any responsibility for any errors arising out of incorrect or incomplete entries.

HTML shall not be responsible for alteration or unauthorized access to entries, or entries lost whether or not arising during operation or transmission as a result of server functions, virus, bugs or other causes beyond its control.

HTML shall not be liable for system/server failures. Neither can HTML be held responsible for the failure to fulfill the obligations of any of the third parties involved in the contest.

HTML reserves the right without prior notice to access, read preserves and/or disclose the personal information of the user if the same is required in connection with this contest.

Decision of adidas with respect to selection of adidas FIFA Fair Play Flag Bearer winners shall be final and binding upon the participants/winners and HTML shall have no say in the same.

Only the winners of the adidas FIFA Fair Play Flag Bearer shall be informed by adidas and only winners of the football gear shall be informed by HTML. The details shall be sent via MOBILE Number provided at the time of registration of the contest. Non-receiving of calls shall result in disqualification and selection of an alternate winner.

The winners would be informed by a phone call and can collect their prizes as per the information provided at that time.

The winners shall be required to produce/submit photo identity/address proof as and when required by adidas. The winners may be required to sign the Terms and Conditions herein before accepting the prize. In case false/fake identification details are submitted, the concerned participant/winner shall be disqualified immediately from the contest.

Though adidas and HTML shall make every effort to declare the results of the contest on the due date for the respective prize draws, it shall not be responsible for any delay in announcing winners of the respective prize draws arising out of reasons beyond its control in the normal course of business.

adidas and HTML holds no responsibility or liability in case they are unable to inform the winner of his/her win due to non availability /wrong number/wrong email id or any other reason within a period of 30 days from holding of the event, having made despite the best efforts. In such a case adidas shall not be liable to proof the efforts made in this regard.

The winner is solely responsible for any other expenses related to the acceptance/use of the offer or participation in the contest.

Prizes shall not be substituted for cash, either in whole or in part, at any stage of the Contest. The prizes shall be non negotiable and non transferable. In the event of any unforeseen circumstances, HTML reserves the sole right to offer an alternative prize of the same value.

This offer cannot be clubbed with any other offer.

ANY claims arising out or in relation to the Gifts or the trip shall be solely between the winner and ADIDAS and HTML shall not be responsible for the same.

HTML and adidas shall not be responsible for any loss or damage suffered by the winner while availing the offer.

In the event of any winner choosing not to go for the trip adidas shall have the absolute discretion to deal with such prize as it deems fit.

All entries will be treated as the property of HTML and adidas and can be used by HTML and adidas for any promotional and / or commercial activity & the participants/winners waive all rights of whatsoever nature in the said entries in favour of HTML and adidas by participating in the contest.

Participants/winners may be required by HTML and adidas to participate in a photo, video and/or film session and acknowledge that HTML and adidas has the absolute and exclusive right to use such publicity photos, videos and/or films in any medium and in any reasonable manner it may deem fit without any consideration or payment of similar nature to such participants/winners.

HTML and adidas in its absolute discretion may publicize, broadcast or otherwise disclose a participant's/winner's name, character, likeness, statements or any recording of their voice in advertising or promotional activities concerning this contest, or generally. HTML and adidas may promote or advertise that a winner has won the contest.

adidas reserves the right to extend or to cancel, or change the manner in which the contest is organized or discontinue or terminate the contest at any time or to accept or reject any or all entries at their absolute discretion without giving any prior notice without assigning any reason whatsoever.

Any attempt by a participant to deliberately damage or undermine the legitimate operation of the contest and/or web-site is a violation of Criminal and Civil Laws and should such an attempt be made, HTML reserves the right to seek damages from any such Candidate to the fullest extent permitted by law.

adidas reserves the right to disqualify any participant/winner if it has reasonable grounds to believe the participant/winner has breached any of these Terms and Conditions. In the event that any participant is disqualified from the contest, adidas in its sole discretion may decide whether a replacement participant should be selected. In this event, any further participant will be selected on the same criteria as the original participant and will be subject to these Terms and Conditions.

The Contest shall be governed by and construed in accordance with the laws of India. Any disputes, differences and, or, any other matters in relation to and arising out of the Contest and, or, pertaining to the rules and regulations and, or, the Terms and Conditions shall be referred to arbitration under the Arbitration & Conciliation Act, 1996. The arbitral tribunal shall consist of a sole arbitrator to be appointed by adidas. The venue of arbitration shall be New Delhi and the proceedings of such arbitration shall be in English Language only.

All disputes shall be subject to the exclusive jurisdiction of Delhi Courts only.

HTML and adidas in its absolute discretion reserves the right to add, alter, modify, change or vary all or any of these Terms & Conditions, wholly or in part, at anytime without giving any prior notice and the participant/winner agrees to abide by such additions, alterations, modifications and changes.

Participation in the contest implies acceptance of all the terms & conditions herein.

HTML assumes no responsibility w.r.t any claim arising out or in relation to the Trip or any goods offered in terms of this contest. HTML is a mere media platform and has no relation with the contest whatsoever.
