Gujarat high court on Friday rejected the petition of senior IPS officer Rahul Sharma, challenging the show cause notice the Gujarat government had served to him for violation of Official Secrets Act (OSA).
Gujarat high court rejected the plea stating that the court had no jurisdiction on the issue.
The state government has also issued a charge sheet to the official, whose testimonies before the Nanavati commission and the Apex Court appointed SIT had exposed the Modi government, it's ministers and leaders of the ruling party for their complicity in the 2002 riots in which 1200 people were killed.
"The state government has served a show cause notice for charge sheet without providing any grounds as why the official should be charge sheeted. That was challenged in the court, which directed the petitioner to approach appellate authority," Sharma's lawyer Mukul Sinhalese said.
Known for his impeccable integrity and fearless approach, Sharma is DIG (armed units) in Rajkot. During his stint as DCP, police control room, in 2002, he had prepared two CDs containing details of mobile phone records of all the government officials, politicians and ministers, which established the location and movements of the ministers and politicians during the riots.
Those call details form the crucial piece of evidence to prove involvement of several politicians in the riots and also inaction by the police during the worst communal carnage that had claimed 1200 innocent lives in the state.
