A man, who was accused to have sexually exploited a woman under the garb of marriage in West Delhi, has been acquitted by a Fast Track Court in New Delhi.
Absolving Ravinder Singh of charges under Section 376 (rape) of the IPC, Additional Sessions Judge Bharat Parashar also exonerated four others—Iqbal Singh, Keshar Singh, Gurbax Singh and Kuldeep Singh—who were accused of issuing threats to the victim.
"Even if it is presumed that some relationship was there between Singh and the prosecutrix (woman), it could not be established that the same took place against her consent or whether her consent was obtained under some misconception of facts or playing fraud upon her," the court observed.
The prosecution could not establish the fact of marriage in the case as no 'Anand Karaj' was performed, the court found.
An FIR against Singh and four others was filed at Tilak Nagar police station under various provisions of the IPC in 1998 by a woman alleging Singh fraudulently married her even after having a wife and son.
She also alleged that Singh and his friends threw her out of the house before forcing her to terminate her pregnancy with a malafide intention.
