The agency said it was a case of “culpable homicide”, whose definition under Indian law includes types of killing that are not premeditated.

“Manoj Gurjar, driver of the vehicle, had nothing to do with any kind of mining mafia. He was taking the stones for his own personal use,” the CBI chargesheet said. Gurjar has been charged with culpable homicide and obstructing the work of a government official.

The CBI submitted the chargesheet before the court of judicial magistrate (I) Suman Srivastava in Indore. CBI prosecutor Ayaz Hussein Khan said it was “not an intentional murder” and non-political also.

He also said the incident had no connection with the mining mafia. The accused did not even possess driving licence when the death took place, he added. The next hearing in the case will be on June 11.

Gurjar, who was later arrested by the Morena police, however, pleaded innocence before the court.

Narendra Kumar’s father, Keshav Dev, had alleged his son was murdered as he was taking tough action against the illegal mining lobby.
