MP High Court stays proceedings on plaint against Shankaracharya

The MP High Court on Monday stayed the proceedings on a complaint against Shankaracharya Swami Swaroopanand Saraswati of Dwarka-Sharda and Jyotish Peeths for his recent comments on Sai Baba.

The MP High Court on Monday stayed the proceedings on a complaint against Shankaracharya Swami Swaroopanand Saraswati of Dwarka-Sharda and Jyotish Peeths for his recent comments on Sai Baba.

The judicial magistrate first class (JMFC) court at Bhopal took cognizance of the complaint by Sandeep Savne who claimed to be a follower of Sai Baba. The complainant stated that his feelings were hurt by the seer's comments.

The seer moved the high court challenging the cognizance taken by the JMFC court on the complaint.

The seer’s senior advocate AM Trivedi and Aseem Trivedi said under the provisions of the Article 25 of the constitution the rights of citizens were protected on the religious matters so there was no need to entertain the complaint against the seer.

The senior advocate cited a judgment of the Andhra Pradesh in connection with the deputy commissioner of Endowment Hyderabad vs Sai Baba Samsthanam case of 1990.
