Patil seeks bail in Nimbalkar case, says evidence is weak

Incarcerated NCP MP Padamsinh Patil on Tuesday sought bail in a sessions court, contending there was hardly any material to implicate him in the murder of Congress leader Pawanraje Nimbalkar barring statements of co-accused.

Incarcerated NCP MP Padamsinh Patil on Tuesday sought bail in a sessions court, contending there was hardly any material to implicate him in the murder of Congress leader Pawanraje Nimbalkar barring statements of co-accused.

Additional Sessions Judge Arvind Kale, who heard arguments of Patil’s lawyer and CBI, said he will deliver order on the bail plea on July 18.

Patil’s lawyer Shirish Gupte said his client was arrested only on the basis of the statements of other arrested accused, and under the law the evidence in the form of statements and confessions of one accused cannot be used against another.

“This is the weakest form of evidence and the prosecution cannot fully rely on it,” he said.

"The court has to consider the nature of evidence submitted by the prosecution and the confession of co-accused in the case is of weakest character," Gupte argued.

"Patil, who was arrested on June 6, has been in custody only on the basis of such confession of co-accused," he added.
