PCS officer’s writ petition dismissed

The Allahabad HC has dismissed a writ petition filed by a PCS officer, whose daughter had filed an FIR alleging rape against him.

The Allahabad High Court has dismissed a writ petition filed by Virendra Kumar Dohare, a PCS officer, whose daughter had filed an FIR alleging rape against him.

In the writ petition, Dohare had sought quashing of the FIR and also a stay on his arrest.

Dismissing the writ petition, a division bench comprising Justice Amar Saran and Justice RN Mishra directed the investigating officer to conclude the probe of the case within three months and also submit a compliance report before the court by July 3.

The petitioner had moved the court challenging the FIR dated October 25, 2006 registered at Nawabganj police station, Kanpur Nagar under Section 376, 323, 354 and 506 of Indian Penal Code. The petitioner has pleaded that allegations were false because he had opposed the marriage of his daughter with one Satya Prakash. That is why the story had been fabricated to falsely implicate him in a criminal case.

Dismissing the writ petition, the court observed that facts clearly showed that the complainant had been levelling allegations against her father for sexual harassment in a guarded language continuously since 2001.
