A Division Bench, comprising Justice AK Yog and Justice Tarun Agrawal, will hear the case on Monday.
Petitioner Chandra Narain Tripathi alias Chandu has filed the writ seeking permission of the court to direct the respondents to extend the date for depositing the membership fee of practising lawyers of HCBA.
A demand had been made by HCBA members for extending the date for clearance of membership dues. As per the notification of the HCBA, only those lawyers are entitled to vote in the election whose membership dues are cleared upto October 2005.
Quite a number of lawyers had moved a representation before the Returning Officers seeking extension of the date for membership dues as according to them they could not deposit the dues earlier due to lack of proper information.
According to some lawyers, the dues of several non-practising lawyers have been deposited by the candidates in order to get their votes. They say that in the previous years also, the date for depositing the membership dues was extended, but the same has not been done this year.
