Chief judicial magistrate AK Gopakumar turned down the plea in this regard by Janet Mary, aunt of Ajesh Binki, one of the two fishermen allegedly shot dead by the marines, based on the police report in the case.

The police report stated that the two marines, charged with murder in the case, would not come under the authority of the ship captain.

The report pointed out that the rank of the marines were above that of the captain, and, in such circumstances it was not possible to make the captain as an accused in the case.

Marines Latore Massimiliano and Salvatore Girone have been on remand since February 19 and lodged in the Central Prison at Thiruvananthapuram.

They were arrested on February 19 and charged with murder of fishermen Valentine Jalastine and Binki, who had put out to sea from Neendakara here.
