REL moves HC, challenges MTHL bid

REL is alleging that MSRDC did not consider relevant info and material before disqualifying the bid, reports Urvi Jappi .

Reliance Energy Limited (REL) has approached the Bombay High Court challenging the decision of the state government and Maharashtra State Road Development Corporation (MSRDC) disqualifying it from the Rs 4,000 crore project to develop a sea link between Sewri and Navi Mumbai.

MSRDC had called for tenders in February 2004 for constructing a sea link expressway between Mumbai and Navi Mumbai as a part of Mumbai Trans Harbour Link (MTHL).

In the first stage of bidding process, the applicants were required to submit a Request for Qualification (RQF) Document in accordance with Pre-Qualification (PQ) Document issued by the MSRDC.

The first stage of the bidding process is to ascertain parties who were financially and technically qualified to participate in the second stage.

REL has alleged that the MSRDC did not consider all relevant information and material submitted to them before disqualifying the Reliance-Hyundai Engineering & Construction Company Limited consortium.

Hence the consortium has been subjected to "unequal, hostile and discriminatory treatment," claims the petition filed by Reliance Energy.

Reliance has prayed that the state government and MSRDC be directed to issue Request for Proposal Document to its consortium to enable it to participate in the second stage.
